HOW POLK COUNTY COURTS HAVE HANDLED CHALLENGES TO FENIX CONFESSIONS OF JUDGMENT


Public court records reflect 450+ confession-of-judgment filings by Fenix Capital Funding, LLC in Polk County, Iowa (2024–present).


To date, only two defendants have fully challenged these filings on the merits through to a conclusion:


  • DreamTeam Development (LACL164168)


  • Relaunch Contracting / William Lynch (LACL158498)


Result: In the two known cases where defendants fully challenged Fenix COJs on the merits through to a conclusion, both resulted in favorable outcomes for the defendants. Each case depends on its specific facts.


In addition, when courts have independently scrutinized filings or set hearings:


  • Guardian Aero Services (LACL157561) → judgment refused and case dismissed


  • Ermis / JTE Construction (LACL157281) → withdrawn by Fenix immediately after court set hearing


THE TWO FULL CHALLENGES


1. Relaunch Contracting / William Lynch (LACL158498)


Outcome:


  • Judgment SET ASIDE
  • Garnishment QUASHED


Why it succeeded (from public record):


  • Failure to comply with Iowa Code § 676.3 verification requirements
  • Defective affidavit supporting confession of judgment


What mattered:→ The filing did not meet statutory requirements on its face



2. DreamTeam Development (LACL164168)


Outcome:


  • Court REFUSED summary enforcement
  • Case ordered into FULL TRIAL as an ordinary action set for November of 2026


Why it succeeded (from public record filings and court action):


  • Non-credited payments
  • Material overstatement of the amount claimed
  • Lack of supporting accounting
  • Verification defects
  • Fraud / mistake issues raised
  • No meaningful Iowa nexus
  • Conflict-of-law issues (NY / PA vs Iowa)


What mattered:→ This was not a single-issue challenge — it attacked:


  • the number
  • the affidavit
  • the forum
  • and the entire enforcement structure


→ The Court determined those issues required trial-level scrutiny



ADDITIONAL CASES WHERE SCRUTINY STOPPED THE PROCESS


Guardian Aero Services (LACL157561)


Outcome:


  • Court REFUSED to enter judgment
  • Ordered correction of defects
  • Case ultimately DISMISSED


Why it matters:→ Even without a full defense, verification defects alone stopped the judgment



Ermis / JTE Construction (LACL157281)


Outcome:


  • Court set a hearing
  • Fenix WITHDREW the filing immediately


Why it matters:→ When the Court required scrutiny,
→ Fenix chose not to proceed



WHAT THESE CASES SHOW — CLEARLY


Across all known instances where a Fenix confession of judgment was:


  • directly challenged, or
  • meaningfully scrutinized by the Court,


the result has been:


  • Vacatur (Relaunch)
  • Dismissal (Guardian Aero)
  • Withdrawal (Ermis)
  • Forced trial instead of enforcement (DreamTeam)


WHY THESE CHALLENGES WORKED


Across these cases, the same core issues appear:



1. “JUSTLY DUE” FAILURES


  • Payments not credited
  • Amounts overstated
  • No accounting supporting the number


2. VERIFICATION DEFECTS


  • Missing or defective jurat
  • Improper or insufficient sworn statements


3. TIMING ISSUES


  • Confessions signed before default
  • Numbers fixed before they could be accurate


4. FORUM PROBLEMS


  • No real connection to Iowa
  • Polk County used as a filing venue for out-of-state disputes


5. ENFORCEMENT BEFORE VALIDATION


  • Bank freezes
  • Processor disruptions
  • Third-party interference


THE BOTTOM LINE

Out of 450+ filings, the few cases that have been:


  • fully challenged, or
  • forced into judicial review


have not resulted in routine enforcement.


Instead, they have resulted in:

  • or matters being forced into full trial
